1. About us
These terms apply to services sold on aseray.ltd by ASERAY LTD, a company registered in England and Wales under company number 17186619, with its registered office at Suite 10790, 5 Brayford Square, London, E1 0SG, United Kingdom ("we", "us", "our"). You can contact us at [email protected].
2. These terms
By placing an order you agree to these terms, our Refund and Cancellation Policy, our Delivery Policy and our Privacy Policy. If you are buying as a business, the parts of these terms that only apply to consumers do not apply to you.
3. Our services
Each package on our website lists what is included, the price and the expected delivery time. Anything not listed in the package description is outside its scope and can be quoted separately. Images and examples on the website are for illustration.
4. Placing an order
Your order is an offer to buy a service. The contract between us is formed when your payment is successful and we send you a confirmation email. If we cannot accept your order, for example because the service is unavailable, we will tell you and refund any payment in full.
5. Prices and payment
Prices are shown in US dollars (USD). Where VAT applies, it is added and shown at checkout before you pay. Payments are processed securely by Stripe; we do not see or store your full card details. For one-off packages, payment is taken in full at checkout. For monthly or annual plans, payment is taken at checkout and then automatically on the same date each billing period until you cancel.
6. What we need from you
To deliver the service we need information, content, access details and approvals from you. Delivery times start when we have received what we asked for in our onboarding brief. If you are late providing these, delivery will be delayed accordingly. You are responsible for making sure that content you provide (text, images, logos, trade marks) does not infringe anyone else's rights.
7. Delivery and revisions
We will deliver the service within the time stated in the package description, measured in business days. Each package includes reasonable revisions within its stated scope. Our Delivery Policy explains how and when services are delivered.
8. Intellectual property
When you have paid in full, you own the final deliverables we create specifically for you, such as website designs and written content. We keep ownership of our pre-existing tools, code libraries and know-how, and grant you a non-exclusive, perpetual licence to use them as part of the deliverables. Third-party software, fonts, themes and stock images are subject to their own licences. Unless you ask us not to, we may show the finished work in our portfolio.
9. Subscriptions
Monthly and annual plans renew automatically. You can cancel at any time by emailing [email protected]; cancellation takes effect at the end of the current billing period and you will not be charged again. We may change the price of a plan by giving you at least 30 days' notice by email, and you may cancel before the change takes effect.
10. Cancellation and refunds
If you are a consumer, you have a legal right to cancel within 14 days. How this works for services, and how refunds are calculated, is set out in our Refund and Cancellation Policy.
11. Our liability
If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach or our failure to use reasonable care and skill. We are not responsible for loss that is not foreseeable. If you are a business, we are not liable for loss of profit, loss of business, business interruption or loss of business opportunity, and our total liability to you is limited to the price you paid for the service concerned. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law. If you are a consumer, nothing in these terms affects your statutory rights.
12. Events outside our control
We are not responsible for delays caused by events outside our reasonable control, such as outages at hosting or payment providers. If this happens we will tell you and take steps to minimise the delay.
13. Complaints
If you are unhappy with our service, please email [email protected]. We aim to reply within 2 business days and resolve complaints within 14 days.
14. General
We may update these terms from time to time; the version on our website at the time of your order applies to that order. If a court finds part of these terms invalid, the rest will still apply. These terms are governed by the law of England and Wales. If you are a consumer living in Scotland or Northern Ireland, you may also bring proceedings in your local courts.
